General Terms and Conditions

§ 1 Scope

(1) These Terms and Conditions apply to all orders placed through the Lowcut Labs online shop (lowcutlabs.com).

(2) The version in force at the time of the order is binding.

(3) Conflicting or additional terms of the buyer are not accepted unless we expressly agree to them in writing.

§ 2 Platform and contracting party

(1) The operator of Lowcut Labs is Joshua Hahn, Waldsteinweg 2, 95126 Schwarzenbach a. d. Saale, Germany, lowcutlabs@gmail.com.

(2) Lowcut Labs provides an online marketplace for beats and melodies. For catalog of external producers we act only as intermediary and technical service (hosting, payments, download links) and do not become a party to the purchase contract.

(3) The purchase contract for a beat or melody of an external producer is formed directly between you and that producer. The producer’s name is shown on the product page, in the cart and in the order confirmation.

(4) Beats and melodies offered by the operator himself under “Kid Patron” are sold by Joshua Hahn.

§ 3 Prices, currency and payment

(1) All prices are final prices in euro (EUR). Checkout and settlement are exclusively in euro. If your bank or card is in another currency, your payment provider handles any conversion; any conversion fees are borne by you.

(2) For orders from outside the EU, customs or local taxes may apply in your country. We deliver digital content only.

§ 4 Delivery of digital content

(1) All products are digital audio files. There is no physical shipment.

(2) After successful payment you receive an email with time-limited download links (MP3, WAV and/or stems). Links are valid for 7 days.

§ 5 Licenses

(1) Beats are sold as an exclusive worldwide license. After purchase the beat is removed from the shop and is not sold again. Details are in the Exclusive License.

(2) Melodies are offered as exclusive, limited or unlimited. Limited and unlimited licenses may be sold more than once. Details are in the Melody License.

§ 6 Right of withdrawal

Consumers have a 14-day right of withdrawal from the conclusion of the contract. We do not ask you to waive that right for digital content, so it remains in full even after the download links are provided. You can use the electronic withdrawal function at /widerruf.

§ 7 Warranty and liability

Statutory warranty rights apply. If a file is damaged we will provide new download links. Unlimited liability remains for injury to life, body or health and for intent or gross negligence. For other damage we are liable only for breach of an essential contractual duty and only for typical foreseeable damage.

§ 8 Final provisions

(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

(2) If you are a consumer with your habitual residence outside Germany, this choice of law does not deprive you of the protection of the mandatory provisions of the law of your country of residence (Art. 6(2) Rome I Regulation).

(3) The contract language is German. This English translation is for information only. If the German and English versions differ, the German version prevails.

(4) With the order confirmation you receive the order data and a reference to these terms and the withdrawal information in the version applicable at the time of order.
